Expert Spanish property lawyers Fuster & Associates have issued a warning to all those who lost deposits to property companies that went bust in Spain and have yet to try and claim the money back. The company has warned that those who don’t take action in the next six months will miss their chance to reclaim any of their lost funds. That’s because the deadline for requesting the return of funds given to a property developer is 7 October 2020.

Fuster & Associates has already helped more than 200 people recover the deposits they put down on Spanish properties in the early 2010s and subsequently lost due to developers going bust. To date, the firm has a 100% success rate for such cases.

On 7 October 2015, the Spanish Supreme Court took action in favour of those buyers, in a ruling that assigned a share of the responsibility to Spain’s banks and that gave the would-be buyers five years to take action. The court asserted that those banks that had failed to ensure that guarantees were in place to return payments in the event of a breach were liable to pay out in certain circumstances.

“Buyers with non-delivered homes who signed contracts between 7 October 2005 and 7 October 2015 have until 7 October 2020 to make a claim. Those who signed contracts later must also take the new regulatory regime that came into force on 1 January 2016 into account.”

That regime requires real estate developers to guarantee the amounts paid by buyers from the moment the building licence is obtained, rather than from the signing of the private purchase contract, as was previously the case. The change means that the buyer must ensure that the developer has been granted a building permit before they hand over any funds. If they don’t, there will be no guarantee or surety insurance that they will be able to reclaim any of their funds should the developer go bust.

Buyers looking to avoid such issues now have a solution in the Fuster Standard. There’s no question that Spain’s tourism sector had a good year last year. The National Statistics Institute (INE) reports a 1.1% increase in visitor numbers in 2019 (compared with 2018), with 83.7 million foreign tourists spending €92.278 million (a 2.8% increase on 2018).

With increased visitor numbers comes increased interest in second homes and figures from leading Spanish home builder Taylor Wimpey España show that Britons are leading the charge. UK interest in the company’s website was up by 32% year to date in February, while second home sales to British buyers were up by a staggering 233%.

The trend is mirrored by figures from Kyero, where international buyer figures rose 23% in 2019 when compared to 2018, with British website visitor numbers up 32% year on year as at Q4 2019.

The Office for National Statistics (ONS) reports that people in their mid-30s to mid-40s are three times more likely to be renting than those in the same age group were 20 years ago. Of these middle-aged renters, a third were renting privately in 2017, up from just one in ten in 1997. 

UK rent guarantor service Housing Hand has flagged this up as a concern, both in respect of those trapped in the rental sector at present and in relation to their outlook as they age.

There’s been a marked change in the number of those renting later into life over the past two decades. What does this mean for those renters as they get older? At the same time, the number of young people who own their own home is dropping, so the number of older renters will continue to swell.”

The ONS figures show that half of people in their mid-30s to mid-40s had a mortgage in 2017, down from two thirds back in 1997. Combine this with the rise of freelancing in the UK (the country is now home to two million freelancers) and it’s easy to see why there’s a growing demand for rent guarantor services.

In theory, the new Housing Minister, Christopher Pincher, who replaced Esther McVey during the February 2020 Cabinet reshuffle, has it in his purview to tackle the difficulties faced by middle-aged and older renters. However, not everyone has faith that this will be a priority. The fact that there have been 19 Housing Ministers in the last 21 years means that none of those appointed have had the time to fully understand, consult, implement changes and then monitor their effects fully. It means that Pincher, whose tenure will no doubt be as short-lived as those of his 18 predecessors, will have little chance to improve the current situation. 

“The housing market is incredibly complex. Without sufficient time to analyse and understand its complexities, Housing Ministers are forced to make knee-jerk, headline-hitting decisions, which they then don’t take ownership of because they’re usually replaced by the time their ideas have been fully implemented. It’s unlikely that a long-term solution to the increase in the number of middle-aged and older renters will be found under such conditions.”

Nor is it necessarily in the government’s interest to move people out of the private rented sector. Some of the tenants that Housing Hand has worked with are paying as much as 70% of their income on rent. Consider that in some circumstances over 40% of that rent goes to the government as tax, the combined tax income is astonishing. 

The company gives an example of a tenant earning £2,000 per month and paying a monthly rent of £800. The combined landlord and tenant tax income comes to £1,253 per month. How much enthusiasm exists to mend the broken housing market in such circumstances is certainly open to speculation. Taylor Wimpey España had already shared details of its new Compass development in Mallorca’s Cala D’Or, where construction is already underway. The two-bedroom/two-bathroom apartments with spacious terraces will have two communal pools and spacious landscaped grounds, within easy reach of the stunning cove beaches that dot the south-east Mallorca coastline.

Leading Spanish home builder Taylor Wimpey España has reported a 125% jump in British buyer numbers, as the uncertainty around the UK’s departure from the EU has finally turned into action. Brits were the top buyer nationality in both December 2019 and January 2020, with total growth across the two months standing at 125%.

Almost all British buyers during that period were focused on properties in the Costa del Sol. It’s one of three areas that the Taylor Wimpey España team has flagged up as Spanish summer hotspots this year. Of particular interest is the prestigious La Cala Golf resort, where holidaymakers and second home buyers can enjoy a wide range of luxurious facilities, including tennis, football and spa facilities, top end dining experiences and three superb championship golf courses.

Some of the best homes for enjoying the stunning views that stretch out over the fairways and rolling countryside to the distant mountains are the key-ready apartments at Grand View. Available from €265,000 + VAT, the two- and three-bedroom homes enjoy both a beautiful setting and high-end fixtures and fittings. British interest in the Costa del Sol is mirrored by buyers from Spain itself and from other countries. According to the Colegio de Registradores, there were more sales in Andalusia in Q3 2019 than in any other Spanish region. Andalusia accounted for 19.55% of total property sales, with Catalonia coming second with 16.41%. New homes in Andalusia proved particularly popular during the quarter, rising by 5.85% compared to a year earlier.

The Costa Blanca – over 200 km of sun-kissed coastline – is another of Taylor Wimpey España’s summer 2020 hotspots. At Elche in Alicante, smart, three-bedroom townhouses with a communal pool and private terraces and solariums are priced from €179,000 + VAT at Kiruna Residencial.
